Troubling court ruling against drone activity
A Michigan Court of Appeals ruled 2-1 that a township can’t use drone photos it obtained without a search warrant.
The issue came up when Long Lake Township hired a drone photographer to capture photos of a couple’s backyard to show there was “a significant amount of junk”.
The couple argued that the action was an invasion of privacy and a violation of the 4th amendment, which protects people from “unreasonable searches and seizures.”
A trial court denied the request initially and it ended up in the Appeals Court.
The Judge mentioned that she was concerned about the “intrusive nature of drones”
This is in contradiction with the Supreme Court ruling that items visible from “public navigable airspace” are not protected by the 4th amendment.
FAA Symposium is back
The FAA Symposium is back for 2 virtual episodes.
Episode 1 (named episode 3) on June 9-10
Episode 2 (named episode 4) on Sept 14-15
Pricing is still high, even after the feedback provided last year
$375 for both episodes
$150 for a single day or $249 per episode.
The Board of Examiners for Engineers and Surveyors in North Caroline is making drone pilot’s life difficult.
The board has been sending warning letters to drone pilots who provide images their customers with metadata (including GPS coordinates) and stitching those images together.
The board says that this activity equates to surveying and requires a state-issued license.
Now one photographer is taking the Board to court.
With the help of the Institute of Justice, Michael Jones is fighting back.
He’s saying that his images are not being used to set legal boundaries.
Preventing him from doing this goes against his first amendment right.
If the Board wins, this could set a dangerous precedent and empower other boards across the country. This could also put first responders at risk who are capturing data for accident reconstruction. https://dronelife.com/2021/03/23/surveyors-wanted-to-shut-this-drone-photographer-down-for-providing-aerial-photographs-now-hes-fighting-back/
